Summary: This is a study of the basic conflict between the right to property and certain directive principles of State policy of the Indian Constitution. It is also an evaluation of the impact of this conflict on the decisions of the Supreme Court in the area of property rights. It argues that the Court, preoccupied with its role as the protector and guarantor of the fundamental rights, failed to give due weight to the directive principles of State policy. Even after the enactment of the 4th Amendment, which radically modified the article on the right to property, it clung to the strict rule of statutory interpretation inherited from the British and refused to take into account the intent and purpose of the Amendment by consulting its objects and reason.
