The Book is divided into four parts-(1) Provisions in the Constitution of India: (1) The Conduct Rules; (ii) Disciplinary Rules and Procedures; and (iv) Appeals, Revision and Review.
In the first part, reference has been made to Articles 14 & 16(1), Art. 310 and Art. 311 of the Constitution. The great importance of Arts. 14 and 16(1) lies in the pronouncement of the Supreme Court - "Articles 14 and 16 strike at arbitrariness in State action and ensure fairness and equality of treatment". Art. 311 provides constitutional protection to civil servants of the Union and the States.
The provisions relating to Conduct, Discipline and Appeal relating to Goverment servants of the Union and the States have been prescribed in the Conduct Rules and Discipline & Appeal Rules promulgated for various services. The rules are numerous but they follow the basic pattern laid down by the Central Government for Central Civil Services which constitute largest chunk of its employees. A host of Government decisions have also been issued by the Government interpreting the rules and providing guidelines. The rules have been subjected to judicial also. For the purpose of writing this book we have gone by Central Civil Services (Conduct) Rules, 1964 and Central Civil Services (Classification, Control and Appeal) Rules, 1965.
Though detailed analysis of the rules has not been taken up but the treatment is fairly good because fundamentals and basic things mentioned not only in the rules but also in the GOI Decisions have been given. The effect of very important court pronouncements has also been included. Thus, effectiveness of the book has not been sacrificed for brevity. More discerning readers who may like to study the subject in good detail may consult our (1) Law of Suspension, Penalties and Departmental Enquiries; (2) Commentary on CCS (Conduct) Rules; and (3) Commentary on the CCS (CCA) Rules.
