The essence of Government service is the sense of discipline to which all Government employees are subject and the privileges to which they, in general, are entitled. These two aspects are fully covered by two sets of service rules, viz., Central Civil Services (Conduct) Rules and Central Civil Services (Classification, Control and Appeal) Rules. These two sets of rules are considered most important as they relate to the employees' code of conduct and discipline. Out of these two, the CCS (CCA) Rules are consulted in Government offices in connection with discipline cases. It is common knowledge that they are difficult to understand and apply. In dealing with discipline cases, it is imperative that there should be no procedural defects, however small and insignificant they may seem to be, lest such defects should lead to adverse decisions on appeal.
The flood of judicial pronouncements on service matters by the various High Courts and the Supreme Court followed by the judgments rendered daily by the various Administrative Tribunals set up recently in the country for the exclusive and speedy disposal of applications relating to service matters has been taken outside the scope of this book because of its sheer size. We are bringing out separate volumes containing digest of Case-Law, which may be had for reference. Readers interested in Case Law are advised to refer to Swamy's Case-Law Digest originally brought out annually and now coming out every six months from January, 1995. In addition, we have brought out a comprehensive Manual on Disciplinary Proceedings, including chapters on Conduct Rules, Temporary Service Rules, Premature Retirement, Confidential Reports and Administrative Tribunals Act.
