The problem of State liability for wrongful activities of its employees has recently gained tremendous importance as the State has become a major litigant in the Courts of Law. It is becoming increasingly necessary to redefine and reallocate the responsibilities of the State, in view of the fact that in the present era, it is no longer a passive witness with socio-economic struggle of the indi vidual but is engaging itself in numerous activities, most of which have no relation to the so called sovereign functions of the State. This book aims to provide an understanding for resolving the conflict between the individual and the State in the area of State responsibility and endeavours to build a framework for the proper behaviour of the State.
Contents include:
State Liability and the Individual; Crown's
Liability in Tort in England; Federal Tort Liability in the United States; Administrative Liability in France; Liability of the State in India before 1858; State Liability in British India; State Liability under the Indian Constitution; Defence of Act of State; Proposed Legislative Treatment; Observations and Suggestions; Appendices; etc.
"The present treatise is a definite contribu tion to the knowledge both from the theoretical and practical viewpoint. The analysis of Indian and foreign materials on the subject coupled with a fresh interpretation will be of immense help to the bench and the bar and to all those involved and interested in law suits against the Govern ment. Indeed it is a book not only to be adorned in the library but to be on one's table for constant use and consultation as the author has tried to evolve an Indian model of law."
