Anglo-American law has historically been strongly identified both in theory and practice with a tradition which has been concerned with the rights and duties of individuals. Yet in recent years it has been recognized that this tradition is inadequate to cope with a wide range of problems arising out of inequality of means, opportunities and entitlements in society. This conflict has generated increasing discussion of public interest law, and also the development of a whole new corpus of law and institutions explicitly concerned with the manner and techniques by which the public interest is, and can be, explored by the legal system.
This book looks at the whole phenomenon of public interest law, both theoretically and also with extensive reference to practical develop ments. What is it and what is its history? How can it be incorporated into the constitutional and legal system? How can the public interest be mobilized, through legal services and social action groups? What is the future of public interest law?
