Law is a means to an end; Justice is that end. But in actuality, Law and Justice are distant neighbours, sometimes even strange hostiles. If law shoots down justice, the people shoot down law and lawlessness paralyses development, disrupts order and retards progress. This is the current scene.
What is the penance for this pathology? This problem has many facets and the solution has to be fundamental, radical creative and, dynamic. Justice Krishna lyer is among the few 'judicial jurists' who have frankly admitted the malady, boldly attempted a diagnosis and passionately advocated remedies. Founded firmly on the basic values of our Constitution, he has presented on several occasions outspoken criticism of the existing legal system with a constructive orientation and offered new perspectives of social engineering and promises of social justice. His activist adventures in search of answers to the grave issues of Law and Justice and thoughtful presentations are now woven into this book.
The broad purpose of these writings is two-fold. Firstly, Justice is the basis of any society that wants peace and progress. Secondly, Law is the instrument for delivery of justice. And yet the tragic truth is that Law is often not on talking terms with Justice. This should not be, and this book creates a new awareness, a creative consciousness, a purposive art which will expose this unjust and unjustified antagonism and promote a cross-fertilisation of Law and Justice.
To read this work, is to share an unorthodox, refreshing, compelling, and may be provocative rush of criticisms, panaceas and projects. Here is a crusader for a cause battling with his pen. The cause is Indian Justice.
