Summary, etc. | The distribution of legislative powers is the basic postulate of a federal constitution. In this demarcation of powers, the residuary power is one of the important provisions in any federal constitution. But unfortunately not much has been written in this area. One hardly finds any book with a detailed treatment on this subject in any country of the world.

In the present work the author has under taken a detailed examination of the Indian resi duary clause and almost all the aspects of the subject have been appraised. The book high lights the comparative position in the leading federal Constitutions of the world. It traces the legislative history of the provision. The author has also tried to examine almost all the cases on the point decided by the apex court and the various High Courts of India. The response of the Parliament in the field of residuary power also finds a place in the present work. An humble attempt is made to examine the recommendations of the Sarkaria Commission.

The present book tries to formulate certain conclusions, so that the strains in the Centre State relations may be minimised and the Indian federalism may have healthy growth.

This book will help not only the academics and students but also the judges, lawyers, parliamentarians and all those who are interested in the field of Centre-State relations. |
