It traces the historical and legal aspects relating to the accession of Jammu and Kashmir with Indian Union and covers the constitutional aspects of the special status granted to the State within the ambit of the Constitution of India. The distinction which exists between Jammu and Kashmir and the rest of the States under the provisions of Indian Constitution has been highlighted in order to understand the autonomous status of the State. A review of Centre State relations under the Constitution (Application to Jammu and Kashmir) Order, 1954 has also been undertaken with a focus on the recommendations of the State Autonomy Committee. The main thrust of the book is to provide a section-wise commentary on the Constitution of Jammu and Kashmir. Each section is interpreted in the light of corresponding provisions of the Constitution of India and discussed with all distinctions which exist in the light of leading pronouncements of the Supreme Court and High Courts. A special care has been taken to incorporate the relevant judgments of the High Court of Jammu and Kashmir. The book also incorporates appendices on certain important aspects so that it may provide useful information to the readers and thus obviate the necessity for reference elsewhere. The book is addressed primarily with the aim and purpose to give correct and comprehensive account of information for understanding the Constitution of Jammu and Kashmir which will certainly be useful to the legal profession, academicians, students, scholars and readers in general as well. The book is written in a simple style with lucidity of expression. The principles of law are stated clearly. The copious footnotes, it is hoped, will serve the readers in their further pursuit and study of the subject. | ||
