Study of this discipline is concerned more with enforcement 'rights', for environmental pollution may affect individuals as well as the public at large. The impact of pollution may be on the lives of people in the place of occurrence as well as in a larger geographical territory. Further, the impact might be even larger on generations to come. Therefore, if pollution is termed either as a wrong or crime, it requires different understanding of law because of its very nature, wherein the study of environmental jurisprudence gains importance. This book seeks to find the answer of the question, in case of pollution, who is responsible for the pollution, i.e., how is the onus to be fixed on the polluter and how is his liability to be quantified. The perspective of the book is based on Indian Law, but references to other jurisdictional laws and international instruments have been made at appropriate places.
