<br/><br/> This book explores the development of the notion of the legal-rational state through the legal theorising of Hobbes, Bentham and Kelsen and their respective accounts of legal positivism.<br/>An essential ingredient of the concept of modernity must be the construct of the legal-rational state, the emergence of which can be traced to Hobbes in the seventeenth century. Its development is carried on by Bentham in the eighteenth and nineteenth centuries. Its impoverishment, however, in the twentieth century can be attributed to Kelsen. This comparative study of the three chosen theorists is undertaken within the framework of the positivist science of law and in the context of the political and economic preoccupations of their times.
