For multitude of people, religion is no longer a spent force in the reign of secularism but a force which can help the people out of the mess created by materialism which is presently having a full sway over the mental make up and its stinging bite has not spared any body. In such situation religion must have its full dominance or intellect. But religious faith and belief must remain distinct from religious practices which many time clash with public order, morality, policy of social welfare and well being of the society. Law based on religion is considered divide but it must keep its dynamism alive keeping pace with the changing social scenario.
Muslim Law derives its origin from the Holy Quran and strengthened by the Surna, the Ijma and the Kiyas and is considered sacrosanct but its divinity will not become less if it develops along with changing society and meet the present order. Judicial pronouncements did interpret the Muslim Law where it needed paving the way for legislative intervention. However, more or less it has not shattered its shackles of rigidity and thus it has become incumbent to study Muslim Law in the light of judicial interpretation.
